OFFICIAL RULES
THE FOLLOWING SWEEPSTAKES IS INTENDED FOR PLAY IN THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA ONLY AND SHALL BE CONSTRUED AND EVALUATED ACCORDING TO UNITED STATES LAW. DO NOT ENTER THIS SWEEPSTAKES UNLESS YOU ARE 18 YEARS OF AGE OR OLDER AND ARE LOCATED IN THE 50 UNITED STATES OR D.C. AT THE TIME OF ENTRY.
The 2013 Chrysler Sweepstakes ("Sweepstakes") starts at 12:01:00 a.m. Central Time (“CT”) on January 20, 2013 and ends at 11:59:59 a.m. CT on December 31, 2013 (the “Sweepstakes Period”).
NO PURCHASE OR PAYMENT OF ANY KIND NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING.
There are two ways to Enter:
ON SITE: Enter the drawing at various events across the United States held from January 20, 2013 through December 31, 2013 (each an “Event”) by completing the electronic official entry form on handheld devices or an official paper entry form provided by a Chrysler representative at the Events.
ONLINE: Consumer may have their photo taken onsite at an Event and may retrieve their photo via an internet microsite. The URL for the microsite will be provided at the Event. They may enter the sweepstakes via this microsite during the Sweepstakes Period. Entry must include your name, address, date of birth, and phone number or email address,. Entries submitted after the end of the Sweepstakes Period are void and will not will not be entered into the Sweepstakes drawing.
Limit one (1) entry per person/household/email address per day regardless of method of entry. Entrants may not enter with multiple email addresses nor may entrants use any other device or artifice to enter multiple times. Any person who attempts to enter with multiple email addresses under multiple identities or uses any device or artifice to enter multiple times will be disqualified and forfeits any and all prizes won, in Sponsor's discretion. All entries become the property of Sponsor and will not be acknowledged or returned. You need not be present to win. You do not need to complete a test drive in order to enter. Please see the privacy policy located athttp://www.eshots.com/support/privacy.htm for details of Administrator's policy regarding the use of personal information collected in connection with this Sweepstakes.
Eligibility – Sweepstakes is open only to legal residents of the 50 United States and D.C., who are 18 years of age or older and have a valid U.S. driver’s license. Employees and directors of Chrysler Group, LLC (“Sponsor”) and its affiliates and any advertising or promotion agencies who are under contract or have performed work on behalf of Sponsor during the Sweepstakes Period or in connection with this Sweepstakes, and the immediate families (parent, child, sibling and spouse of each) and members of the same household of each of the above, are not eligible. Void outside the USA and where prohibited.
Drawing – A random drawing will be conducted on or about January 17, 2014 from all eligible entries received from both methods of entry combined. One (1) Grand prize winner will be selected. Winner will be notified by phone and/or mail by January 31, 2014. Sponsor is not responsible for any change in entrant’s mailing address, email address and/or telephone number. Odds of winning depend on the number of eligible entries received from both entry methods combined.
Prize – One (1) Grand Prize Winner will receive a credit in the amount of $45,000 to be used towards the purchase of a Chrysler Group vehicle (Dodge, Jeep, Chrysler, Ram or Fiat). Any remaining balance between the amount of the vehicle selected and the $45,000 credit will be forfeited and no cash value will be awarded. Credit may only be used towards the purchase one vehicle. Prize is non-transferable and no cash equivalent or substitution of prize is offered. Taxes on the prize are the sole responsibility of the winner. Winner must be a licensed driver and show proof of insurance prior to taking possession of the vehicle. All tax, title, license fees are the sole responsibility of the winner. Grand Prize winner will be required to accept delivery of the vehicle at a dealership designated by the Sponsor within 30 days of notification that the vehicle is available for delivery. Winner can purchase whatever equipment, upgrades, or options they would like, as long as the cost does not go over $45,000.. Sponsor does not make, nor in any manner is responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the vehicle including but not limited to its quality, fitness for purpose or mechanical condition, except for the standard warranty provided with the vehicle.
Compliance - By entering the Sweepstakes, entrants agree to abide by and be bound by the rules and decisions of the judges. Potential Winner may be required to sign and return an affidavit of eligibility and liability release within 14 days of notification, or prize will be forfeited and may be awarded to an alternate winner. Prizes won by an eligible entrant who is a minor in his/her state of residence will be awarded to minor’s parent or legal guardian who must sign and return all required documents. If a Potential Winner is found not to be eligible or not in compliance with these Official Rules, or if prize notification or any prize is returned as undeliverable, the Potential Winner will be disqualified and any prize won may be forfeited, in Sponsor’s sole discretion. In the event that a Potential Winner is disqualified for any reason, Sponsor reserves the right to award the prize to an alternate entrant who will also be selected randomly, even if the disqualified Potential Winner’s name may have been publicly announced. By accepting prize, winner consents to the use of his/her name, photo and/or likeness for advertising and promotional purposes in any and all media now known or hereinafter invented, without limitation and without additional compensation, except where prohibited.
Conditions - As a condition of entering, entrants agree (and agree to confirm in writing): (a) to release and hold Chrysler Group, LLC its dealers, and any advertising or promotion agencies who are under contract or have performed work on behalf of Chrysler Group, LLC during the Sweepstakes Period or in connection with this Sweepstakes, and each of their officers, directors, employees and agents ("Promotional Parties"), harmless from any and all liability, loss or damage incurred with respect to the awarding, receipt, possession, and/or use or misuse of the prize; (b) under no circumstances will entrant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (c) all causes of action arising out of or connected with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (d) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs. By entering the Sweepstakes, participants agree: (a) to be bound by these Official Sweepstakes Rules and the decisions of the Sponsor and Administrator, which shall be final and binding, and (b) that the Sponsor, its parent, subsidiary and affiliated companies, their respective officers, directors, agents, and employees are not responsible for and shall not be liable for: (1) any incorrect or inaccurate information associated with the Sweepstakes, whether caused by Website users, tampering, hacking, or any of the equipment or programming associated with or utilized in the Sweepstakes; (2) any errors, omissions, interruptions, deletions, defects, delays in operation, or unauthorized access to the Website or in any materials associated with the Sweepstakes; (3) any injury, damage, or loss to participants' or any other person's computer related to or resulting from participating in this Sweepstakes or downloading materials from, or otherwise using, the Website; (4) telephone, electronic, hardware or software program, network, internet or computer malfunctions, failures or difficulties; (5) any design, typographical or other errors in any materials associated with the Sweepstakes; (6) garbled, incomplete, damaged, misdirected, late, lost, undelivered, or unprocessed entries; or (7) any condition caused by events beyond the control of the Sponsor which may cause the Sweepstakes to be disrupted or corrupted. Winner acknowledges that Promotion Parties have not made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose. Any and all warranties and/or guarantees on a prize (if any) are subject to the respective manufacturers’ terms therefore, and winner agrees to look solely to such manufacturers for any such warranty and/or guarantee.
Sponsor may prohibit you from participation in the Sweepstakes if Sponsor determines that you have acted in a manner that affects the administration, security, fairness or proper play or conduct of the Sweepstakes in any way, with intent to annoy, threaten or harass any other participants or the Sponsor. In the event of a dispute regarding the identity of a participant, the participant will be deemed to be submitted by the "authorized account holder" in whose name the email address provided upon registration is registered, provided that person meets all eligibility criteria set forth in the Eligibility section of these Official Sweepstakes Rules. "Authorized Account Holder" shall mean the natural person assigned to an email address by an Internet Access provider, on-line service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Sponsor reserves the right, in its sole discretion, to modify, cancel, terminate, or suspend all or any portion of this Sweepstakes should fraud, virus, bugs, unauthorized human intervention, systems malfunctions, failures or difficulties, or other causes beyond the control of the Sponsor and its agencies corrupt or affect the administration, security, fairness or proper play or conduct of the Sweepstakes. By entering, entrants agree, and by accepting a prize, winner agrees to release and hold Chrysler Group LLC, its subsidiaries, affiliates, directors, dealerships, employees, agents, successors and/or assigns and their advertising and promotional agencies (“Sweepstakes Parties”) harmless from any damage, loss or liability to person or property, due in whole or part, directly or indirectly, by reason of participation in this Sweepstakes or the acceptance, possession, use or misuse of prize or travel in connection therewith. Sponsor assumes no responsibility for any third party's failure to act in accordance with Sponsor's instructions pertaining to the implementation of this Sweepstakes.
Except where prohibited by law, acceptance of a prize constitutes permission to use the winner’s name, biographical information, and/or likeness for purposes of advertising and promotion in all media, including on-line worldwide, without limitation or further compensation.
Governing Law - By entering, entrants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, participant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of State of Michigan without giving effect to any choice of law or conflict of law rules. By entering, entrants consent to the jurisdiction and venue of the federal, state and local courts located in Oakland County, Michigan.
